How tax foreclosure works in New Jersey
If property taxes, water, or sewer charges go unpaid, New Jersey law allows the town to sell a lien on your property. Here’s how it usually unfolds:
- 1
Taxes fall behind
Your town sends notices about unpaid property taxes, water, or sewer charges.
- 2
The town holds a tax sale
A tax sale certificate (a lien) is sold to an investor or kept by the municipality. You still own your home.
- 3
The balance grows
The lien holder may earn interest of up to 18% a year, plus applicable penalties and costs. They may also pay later taxes and add those to what you owe. The actual rate varies.
- 4
The lien holder can file for foreclosure
Generally, a private lien holder must wait two years after the tax sale; a municipality can generally file after six months. Exceptions apply, including for qualifying abandoned properties.
- 5
Final judgment
A Superior Court judgment can bar your right to redeem and affect ownership. New Jersey’s 2024 reforms provide procedures to protect remaining equity in certain cases. An attorney can explain the requirements and deadlines that apply to you.
The good news: in most cases, you can redeem — pay off the lien — until that right is barred by a Superior Court judgment. There may still be time to act, but costs can keep growing.
Every case is different. Confirm your timeline and redemption amount with your municipality and an attorney. See New Jersey’s 2024 tax foreclosure reforms.
Signs you may be at risk
- You’ve fallen behind on property taxes, water, or sewer bills
- You received a notice of an upcoming tax sale
- A company you don’t recognize sent a letter saying it holds a lien on your home
- You were served with a foreclosure complaint from the Superior Court
- You inherited a home and aren’t sure whether the taxes were kept current
Why acting early protects your equity
Your home may be worth far more than the taxes owed. A foreclosure can put ownership at risk. New Jersey’s 2024 reforms provide equity-protection procedures in certain cases, but deadlines and legal requirements matter.
Acting early keeps more choices on the table. You may be able to pay off the lien, refinance, or sell on your own terms. The longer you wait, the higher the payoff and the fewer the options.
You don’t have to figure this out alone, and it’s not too late to ask questions.
